Listed Questions and Answers

  1. What is the purpose of the CG 20 10 07 04 Liability Endorsement form?

This endorsement is designed to extend coverage under a Commercial General Liability (CGL) policy to include additional insured parties. It specifically covers liability for bodily injury, property damage, or personal and advertising injury that may arise from the actions or omissions of the insured or their representatives during ongoing operations for the additional insureds at specified locations.

  2. Who qualifies as an additional insured under this endorsement?

The endorsement allows for the inclusion of individuals or organizations listed in the schedule. These parties are covered only in relation to specific liabilities that stem from the insured's work for them. It’s important to ensure that the correct names and locations are listed to provide appropriate coverage.

  3. What limitations exist regarding the coverage for additional insureds?

Coverage is limited to the extent permitted by law and cannot exceed what is required by any contractual agreement. If a contract specifies certain coverage, the insurance provided cannot be broader than what the contract stipulates. This ensures that the coverage aligns with the contractual obligations of the insured.

  4. Are there exclusions to the coverage for additional insureds?

Yes, the endorsement includes specific exclusions. Notably, it does not cover bodily injury or property damage that occurs after all work on a project has been completed, or if the work has been put to its intended use by someone other than another contractor or subcontractor involved in the same project. This means that once the project is finished, the additional insured is no longer covered for incidents arising from that work.

  5. How are the limits of insurance determined for additional insureds?

The limits of insurance for additional insureds are defined by the lesser of two amounts: what is required by the contract or the available limits under the policy. This ensures that the coverage does not exceed what is contractually obligated, maintaining consistency with the insured's agreements.

  6. Does this endorsement increase the overall limits of insurance?

No, this endorsement does not increase the applicable limits of insurance. It operates within the existing limits of the policy, ensuring that the coverage for additional insureds is accounted for without raising the overall coverage amounts.

  7. What should be included in the schedule section of the endorsement?

The schedule should clearly list the names of the additional insured persons or organizations, along with the locations where covered operations will take place. This information is crucial for identifying the parties and places that are eligible for coverage under the endorsement.

  8. How can I ensure compliance with the requirements of this endorsement?

To ensure compliance, review any contracts or agreements that require additional insured coverage. Make sure that the endorsement aligns with these requirements and that the necessary parties are included in the schedule. Consulting with an insurance professional can also provide clarity and ensure that all aspects of coverage are properly addressed.
